Monmouth, Ocean, & Middlesex County Fence Regulations

Building Permits

After deciding to move forward with your fence project, getting a zoning approval and or building permit for your new fence is the first step. Most townships have restrictions based on township ordinances and the particular zone your property is located in. You may approach the zoning department of your township to see if there are any restrictions that may apply to your property. You will need to present the survey map of your property detailing the height, style and location of your fence and they will, free of charge, advise you of any restrictions that may apply. If there are restrictions of your plan, the township may offer you some alternatives that may help you achieve your goal. If there are no restrictions, you may be able to apply for the zoning approval or permit right on the spot. As a last resort, the township may let you apply for a variance to object to a particular zoning rule if there is a situation that is questionable with regards to zoning ordinances and laws.

Fence Installation


Before installing residential fences, it’s important to figure out if you have any deed restrictions set on your property. Some examples of deed restrictions include limitations of fence styles or height location restrictions, as well as the spacing between pickets.

Pool Fences

In the state of New Jersey, all pools must have a fence enclosure to protect pets and small children from your pool. Here are some of the most important requirements:

  1. Fence must be a minimum of 48 inches in height.
  2. When horizontal members of fence are less than 45 inches apart the picket spacing must be reduced to maximum 1 ¾ of an inch. Also, the rails, if any, need to be on the inside of the fence.
  3. All gates must swing outwards from the pool and self-close and self-latch.
  4. All gate latches must be at least 54 inches from the ground.
  5. All chain link fences should be of the 1 ¼ inch non climb type.

These are just some of the standard requirements for pool enclosures.  Keep in mind that townships may interpret laws in their own manor. The best thing to do is to talk to your township officials to see what is exactly required in your municipality and situation.
